The laws of armed conflict are reasonably clear on the restrictions on a national warship firing on a national warship of an opposing combatant that is not carrying ammunition for its main armament.
Namely: there arenโt any.
There isnโt any requirement for immediate threat or anything similar.
In passing, what Hegseth et al are doing in the Caribbean is not armed conflict, for all their lies and bull on the subject; and, even if it were, would be a breach of the LOAC (as in the Peleus case v. the Laconia Order).
