A possível revisão da Lei da Anistia no caso Rubens Paiva, por exemplo, vai dizer muito mais sobre a relação do Judiciário com as Forças Armadas do que a denúncia oferecida pelo PGR (que, diga-se, não integra o Judiciário).
Não é esse o argumento do fio, que discute mudanças institucionais. Ainda que “ficar em cima do muro” possa configurar um crime (pode ser prevaricação, por exemplo), não faria sentido algum incluir isso em uma denúncia com foco em crimes contra o Estado Democrático.
Não é possível, em ação penal, buscar responsabilização institucional. Exceto para crimes ambientais, o Direito Penal sempre trata apenas da responsabilidades de indivíduos.
