The best moment in the History of the Word Caucasian came in a series of Supreme Court cases during the immigration panic of the 1920s.
The Naturalization Act of 1790 said that only "white" people could be naturalized as American citizens, but that only raised questions about what counted as white?
Same! "The Problem of Immigration in a Slaveholding Republic" by Kevin Kenny really opened my eyes to the impact of slavery on the development of immigration law -- I'm looking forward to reading this new book next year!
Also: This widely obscures the role that the US often has in the countries we later declare “failed.” Often, their mess is our mess.
This is so far into virulent racism, there can be no normalization of this. For a long time, people have said we're on the road to a new Nazi regime. Well, here we are. If you were ever planning to fight violent fascism, the time is now.
Trump and Miller want to turn the clock back to the era of American immigration politics I think few of us were taught honestly about in American public education, outside reading The Great Gatsby
A Harpers Weekly engraving from 1869 depicting Uncle Sam's Thanksgiving Dinner as described in the main text of this skeet. There are also images of Lincoln, Washington, and Grant on the wall.
How Republicans commemorated Thanksgiving in 1869--with a multi-racial/multi-ethnic gathering of people at a table with a centerpiece celebrating universal suffrage and self-government, and with an engraving of Castle Garden, the pre-Ellis Island point of disembarkation for immigrants.
This is just gutter racism and it’s a standard that would never be applied to say, the descendants of Italian immigrants who fled the lawlessness of Southern italy post unification and now staff this fascist administration bsky.app/profile/publ...
This is so deeply at odds with the vision and history of America. Take pretty much any ethnic or racial group that are part of the American mosaic America today - they have all faced the same accusation. The moment these accusations are turned into policy are some of the most shameful in US history
Stephen Miller’s ancestors were Jewish refugees from the pogroms in czarist Russia. They came to the U.S. in the early twentieth century, even as racists said this same stuff about them.
"Concluding that a federal officer’s self-inflicted injuries—arising from his own use of force—can create criminal liability would allow the exception to the warrant requirement to swallow the rule. [...] In short, the indictment offends due process." 7/7
The court also dismissed the charges against Mr. Quintanilla-Chavez because he didn't act "forcibly" and didn't "inflict" injury on the DHS agent. It's so important to see courts hold the line and reject DHS's attempts to lie about the facts. 6/n
Although the court unfortunately relied on the Kavanaugh concurrence in Vasquez-Perdomo to conclude there was reasonable suspicion to stop Mr. Quintanilla-Chavez, there was no probable cause to prolong the stop, no justification for a warrantless arrest, and DHS used excessive force. 5/n
And then they charged him with forcibly assaulting a federal officer (18 USC 111(a)(1)) with an enhanced 20-year penalty for inflicting bodily injury (18 USC 111(b)) -- because the DHS officer hurt himself while punching through his car window! 4/n
...when they could have just talked to him outside his house and asked about his immigration status to develop the requisite probable cause. But they didn't bother. 3/n
The court calls DHS out for not having probable cause of deportability, not having a warrant, and presenting "inconsistent positions" and "largely fictional" stories about what happened. Here, DHS chose to pull him over while driving and punch through his car window... 2/n
Fantastic opinion from W.D. Tex. dismissing criminal assault charges against a man who was sitting in his truck when a DHS agent punched through the window and cut himself in the process. 1/n 1https://storage.courtlistener.com/recap/gov.uscourts.txwd.1172853522/gov.uscourts.txwd.1172853522.64.0.pdf
In fact the Declaration of Independence specifically charges the King with "endeavour[ing] to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; [and] refusing to pass others to encourage their migrations hither."
The white supremacist conceit that everyone in antiquity was living under some kind of global jim crow segregation is just complete bullshit news.harvard.edu/gazette/stor...
Here's a helpful short report from Sen. Schiff detailing how the administration is breaking the law to push visual propaganda (those huge banners of Trump on federal buildings): www.schiff.senate.gov/wp-content/u.... With a comparative slideshow of other authoritarians' banners at the end!
The most important immigration fights right now are about the Constitution. None of it has anything to do with the substance of immigration policy. If you stand with ICE, you stand against the Constitution.
Can the govt...
1. racially profile?
2. set up checkpoints wherever they want?
if we made immigration work how people think it works that would be the biggest liberalization of immigration in American history
I'm excited to participate in this conversation on Thursday, hosted by @fairfightaction.bsky.social. Immigration is a key issue for everyone who cares about democracy, and I can't wait to discuss with Nana Gyamfi of BAJI and the amazing Sherrilyn Ifill!
I was on a great panel yesterday with @naynagupta.bsky.social, @daralind.bsky.social, and Ama Frimpong of CASA to discuss immigration, democracy, and our path forward. Thanks to @thenewrepublic.bsky.social for hosting and moderating! youtu.be/mwnjIVzcZYQ?...
This callous "solution" to a fake "problem" is emblematic of this administration's approach to governing.
And farm work is so hard and punishing on the body that all farmworkers should get free healthcare, as a small token of thanks for the essential labor they perform that provides a steady supply of food for the rest of us!
The administration is not trying to make farm work a more attractive option for people -- raising wages, improving conditions, requiring better labor standards. They are just trying to make people so vulnerable and desperate that they'll be willing to take those jobs.
I started my legal career as a farmworker attorney. These jobs are incredibly difficult -- both hard on the body and requiring skill and know-how. Pay is low, wage theft is rife, benefits are nonexistent, and work is seasonal. It is always, always the most vulnerable who take these jobs.
From "alien enemies" to the "enemy within," it's the fascist two-step.
The publicized crackdown on organized crime (sending supposed gang members to indefinite extralegal detention in El Salvador) is actually facilitating organized crime (collusion between Bukele and MS-13) - using anti-immigrant policy to hide high-level corruption.
