The court also dismissed the charges against Mr. Quintanilla-Chavez because he didn't act "forcibly" and didn't "inflict" injury on the DHS agent. It's so important to see courts hold the line and reject DHS's attempts to lie about the facts. 6/n

Although the court unfortunately relied on the Kavanaugh concurrence in Vasquez-Perdomo to conclude there was reasonable suspicion to stop Mr. Quintanilla-Chavez, there was no probable cause to prolong the stop, no justification for a warrantless arrest, and DHS used excessive force. 5/n

And then they charged him with forcibly assaulting a federal officer (18 USC 111(a)(1)) with an enhanced 20-year penalty for inflicting bodily injury (18 USC 111(b)) -- because the DHS officer hurt himself while punching through his car window! 4/n

The administration is not trying to make farm work a more attractive option for people -- raising wages, improving conditions, requiring better labor standards. They are just trying to make people so vulnerable and desperate that they'll be willing to take those jobs.

I started my legal career as a farmworker attorney. These jobs are incredibly difficult -- both hard on the body and requiring skill and know-how. Pay is low, wage theft is rife, benefits are nonexistent, and work is seasonal. It is always, always the most vulnerable who take these jobs.
