A few hours later I got an reply which said the items were suspended in error and would be reinstated right away.
And indeed, all of the games are up for sale on Etsy again.
I noticed that even though the last response from Etsy mentioned it was their final decision and they would not reconsider, I noticed the help ticket was still open. So after a few days I decided to try once more to explain why I am not pirating anything and that I have permission to sell the games.
I have an update regarding the #gameboy #games in the #etsystore situation.
First of all, I'd like to thank everyone for the support in and outside the #gbdev community, it might have even helped a bit!
There is also an interesting court case. Sega v accolade.
They are not allowed to stop you from releasing games for their platform. However, if you do not pay, you won't get a dev kit etc. Indeed you cannot use the nintendo name on your products, but you can say it is for the Game Boy. As long as you don't make it sound like it is officially endorsed.
In that case, they should have also taken down my blank cartridges. Whichis the only thing they have not taken down.
That is not required. You are allowed to create cartridges and software that work with devices from other companies.
You are not allowed to mention or give people the impression they are official products from the console manufacturer. But you are allowed to say it is to be used with the console.

Shipping and, depending on taxes in your region, also games might even be cheaper for you there.
Since I have permission from all game creators, who make their own games, I explained this but the conversation was abruptly ended by Etsy mentioning they now consider the case closed and will not reconsider.
However, after I explained all of this they suddenly changed the reason to promoting piracy by selling unauthorized or counterfeit copies of video games.
I assume this started because there are now clones popping up on Aliexpress, so some bot probably detected it and thought I wasn't making the cartridges and other things myself. This seemed to be confirmed when I finally got a human to tell me they removed the items because they were a resold item.
Some of you may have noticed some #gameboy games disappearing from the #Etsy shop over the past 3 months. I've been trying to contact Etsy since they removed the first one, but it took 2,5 months to finally get an actual reply instead of the automated ones.
It has been a while since I have released a new game, but here it is! Ninja Twins, a puzzle game from the developer you might know from for example Death Planet or Quartet!
