TBH I'm astonished to learn there is no fee for this. I walk past Ricky Mountain Icehouse most days around lunchtime and there are seldom folks using the patio, even in summer. The boardwalk is in bad shape, is too narrow to start with and is further narrowed by their signage.

Absolutely! This is what we are fighting as a downtown business. Folks come to browse because they have a dental appt, not because there's a core of several interesting places to visit. I love a good coffe shop, but it can't be all coffee shops and donairs if we want folk to want to visit downtown.
