Is the article taking liberties with accusing ChatGPT of “impersonating a lawyer”? Did the ChatBot outright pretend to be a human lawyer? Or did it just give hallucinated/nonsense legal advice when asked?

If the former, that’s against the law for a human. If the latter, I’m thinking Darwinism.

Generally, the penalty for unauthorized practice of law is striking the offending pleadings, not a private cause of action for damages, and only the AG’s office or law enforcement may pursue penalties.

For clients, the (perceived) efficiency is already making rates and fixed fees ever more competitive.

(3) the defendant did not communicate with the Al tool for the purpose of obtaining legal advice.
The Court also concluded that the work product doctrine was unavailable because the defendant generated the Al materials independently, rather than at the direction of counsel. [2] In reaching its decision, the Court made clear that Al's "novelty" does not mean its use "is not subject to longstanding legal principles."[3]

For big law firms that can afford proprietary LLMs, this is no problem. Secure internal system keeps privilege and work-product intact.

But for smaller firms and pro se litigants, this is a huge disadvantage (but maybe an opportunity for an entrepreneur to develop an à la carte legal LLM).
