Without an AUMF or DoW we’re splitting hairs here. The biggest problem is that the executive branch decided to initiate hostilities unilaterally, without any buy in from other branches or even the public. IMO all strikes are at minimum illegitimate due to this fact, although ship still feels worse.
Actually thinking about this more… the tankers would need to be insured *well* above fair market value for this to be attractive. If the payout is just a ship or you could wait ~3(?) months and have each transit make you $140(??)/barrel revenue, everyone will choose to wait.
