1 Before formulating regulations, be clear about the risk you are trying to reduce (too many organisations assume regulations are needed, but without really investigating why).

2 Make sure that the regulation actually targets the risk (too many organisations want to show that they are 'doing something' but the something may have no relation to the actual risk).

3 Make sure that the regulation will actually reduce the risk, not increase it (if people don't like the regulation, and try to get round it, its possible that you will increase the risk).

4 Make sure that the regulation does not have side effects that are worse than the risk that is being reduced.

Once you've done this you can start talking about transparency and simplicity, which is where the discussion too often starts.
