By September 2025, Switzerland must deliver:
✅ A clear, enforceable CO₂ ordinance
✅ A transparent national methodology for emissions reductions
✅ A quantified carbon budget or equivalent framework
✅ Adaptation measures and procedural safeguards
Switzerland still has to prove that its climate policies are strong enough to align with the 1.5°C global warming limit. Switzerland must now prove that its climate policies align with the 1.5°C warming limit—and that means more than vague promises.

The Council of Europe’s Committee of Ministers (CMDH) rejected Switzerland’s claim that it has already fulfilled the European Court of Human Rights (ECtHR) judgment in the case of the KlimaSeniorinnen.

✅ Customary international law emerges from consistent state practice & a belief that such practice is legally obligatory. Given the near-universal recognition of the right to a healthy environment & its link to other fundamental rights, its customary status is both legally & morally compelling.
✅ Recognition in international instruments: From the 1972 Stockholm Declaration to the Rio & Johannesburg Declarations, key international texts have consistently acknowledged this right. In 2022, the UNGA recognized it as fundamental, with overwhelming state support (161 votes in favor, 0 against).
✅ Widespread State practice : a vast majority of states have already recognized the right to a healthy environment, through international agreements or their own legal systems. 100+ countries have enshrined this right at the constitutional level, making it a cornerstone of their legal frameworks.
As we outlined in our amicus curia brief, there are strong legal grounds for asserting that this right has acquired customary international law status:

A healthy environment is a prerequisite for the realization of all #HumanRights.
