A further punt for my Prospect piece and my follow-on piece on solving the puzzle of why Prince Harry's case against News Group Newspapers came to its sudden end.
These posts are not quick and easy to put together, and here I had to read over 13 case reports to get any sense of what really went on.
If this theory - and it is only a theory, based entirely (with one exception - the Tomlin Order point, which came from someone in court) on a close reading of the public domain documents and a knowledge and experience of civil litigation - is correct then many things are explained, which otherwise cannot be explained. It explains the volunteered public apology in its wide-ranging terms and its open admissions - in contrast with how the Hugh Grant claim and other claims ended. It explains the timing - which cannot be explained by costs risks on the defendants. It explains why NGN did not proceed to trial even though it had a good arguable but technical defence. It explains all the odd procedural technical details of how the case came to an end. It makes sense - wheras the “costs risk” explanation of other commentary did not make sense and match the facts.

The best explanation is perhaps not that the prince and Watson had finally buckled to costs risk; it instead looks like a desperate last-minute move by a publisher anxious to avoid a public trial of the claims. It appears from the evidence available that NGN signalled that it would actually accept liability. If so, this would change everything. If NGN accepted it was liable for at least the main part of the claims, there would be no need for a full trial—for there would be nothing to be tried. The prince and the politician would not now be able to force a full trial even if they had wanted to do. For a defendant to admit liability is an unusual, if not unique litigation ploy.

This is important. Prince Harry is the one royal who refused to accommodate Murdoch’s sharks.

Rupert Murdoch's NGN issued a formal apology to Prince Harry and acknowledged its private investigators/journalists hacked his phone, surveilled him, and misused his private information, & acknowledged the "intrusion" of Princess Diana.
They "agreed to pay him substantial damages."
