B/c administration officials routinely lie and congressional Rs (and maybe Ds) arenโ€™t interested in the truth, the most interesting thing about AG Bondiโ€™s appearance today (literally, in the literal sense) is that she appears to have told her makeup person to tone things down.

I may be old-fashioned but I donโ€™t think that judicial opinions should include phrases like โ€œperfidious lust for human powerโ€ even when they reach results I likeโ€”for prudential reasons (more likely to be reversed) and more important because being a judge means cultivating a habit of being judicious.

As a graduate of Yale Law School I think Iโ€™m entitled to say that every time JD Vance says something about the state of the law he shows that he went to Yale Law School. (The federal officer removal statute exists so that federal officers wonโ€™t be tried in kangaroo courts.)

1/ A thought provoked by another post: Given the 1st Amโ€™s 1st word, does the Am impose any limits on presidential action pursuant to Art II powers (not delegated to Pres by statutes)? A 1985 article by Mark Denbaux asks parallel question re judicial orders pursuant to inherent judicial authority.

Mark Denbauxโ€™s 1985 article โ€œThe First Word of the First Amendmentโ€ addresses 1st Amโ€™s application to judicial orders. I donโ€™t know if thereโ€™s an article sayng that 1st Amโ€™s plain text doesnโ€™t impose any limits on presidential action pursuant to Art II powers (not delegated to Pres by statutes).

1/ Walz & Frey have obstructed the enforcement of federal law by their statements in almost exactly the same way that Charles Schenck obstructed the draft in the leaflet he distributed. Defining Heritage Americans: My daughterโ€™s mother (i.e., my wife) is eligible for membership in the Colonial Dames. My grandparents came to the US in the early 1900s. Is my daughter a Heritage American? (Donโ€™t ask about her maternal grandfather.) Why not just say โ€œwhiteโ€ and have done with it?

No signed opinions in argued cases before Jan 1 this Term and in the 2022 Term. Used to get at least 1 in Dec & not infrequently a few in Dec and a few in Nov. Conditions on the Court appear to be such that JR canโ€™t even be a good manager. Pretty clearly an effect of the shadow/emergency docket.
