That is true. Although I think one my main aims as a family lawyer is encouraging parties to move away from talking about the past and into talking about the future. It’s rare that anyone is better off after a divorce financially than before. But at least they have autonomy over their future.
Hi Jacob. I’m a family mediator. You make good points. But often in family cases there is more than just the business side of dividing finances, especially when the parties are in different places emotionally. Devoting a whole day can work sometimes but it can become exhausting and go backwards 1/2
2/2 It is best to start family mediation in shorter 2 hour sessions and the full day set aside for when all the information and figures are to hand and everyone has had the time and advice they need
In my mind, the two core requirements of mediation are a) a willingness to talk; and b) the time to do so. With family cases being extremely complex & emotionally difficult, I wonder if the standard model ought to be: “we will set aside a whole day to talk until we can resolve matters?” 2/2
