I hadn't thought about curiosity in the (almost) binary way you describe, but you're right. When interviewing, I've been looking for "thinks like a designer". Implementation details can be coached, but it's hard for me to teach someone how to break a problem into solvable parts.

Afaik, gov requested 8 warrants from a magistrate, who gave 3 but rejected the rest (including Lemon's). Then gov went to court to override the magistrate, which is what you're showing here. One remedy in that decision was to seek grand jury indictments, which seems like what's happening now
