Under the rules of European patent law, inventions whose commercial exploitation is contrary to morality are denied exclusive protection; however, there is currently no standardised mechanism for interpreting the morality exception. In this pioneering book, Joanna Wisniowska proposes a novel method of interpreting the morality clause in European patent law.

This timely book traces the evolution of the Green Climate Fund (GCF) since its establishment in 2010. Ruth Adler investigates whether it has the legitimacy necessary to substantially contribute to the achievement of the objectives of the Paris Agreement, including limiting the increase in global average temperature to less than 2°C above pre-industrial levels.

Elgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary.

This incisive book examines cutting edge issues in environmental compliance and enforcement law. It highlights critical research needs in the field, and explains how their realisation would enhance the efforts of governments, citizens and regulated entities in ensuring compliance and enforcement.

This book provides a fresh perspective on the enduring debate surrounding the sustainable regulation of straddling and highly migratory fish stocks. Alexandros X.M. Ntovas highlights how these vital fish stocks occupy a contested regulatory space where sovereignty, science and sustainability converge.

This prescient Research Agenda sheds light on current and expected developments of military law. It provides expert guidance on the application of international law to military operations and assesses new challenges such as AI, hybrid warfare and the militarization of outer space.

Using legal doctrinal and analytical methods, leading scholars and practitioners in the field survey the current legal landscape, providing a forward-looking analysis of emerging issues and future research. The book examines how international law regulates the use and application of armed force or coercive measures by the armed forces of States and other international actors in an armed conflict or in a ‘grey zone’ pre-conflict setting. Chapters interrogate the functions and rules of the different bodies of international law that govern the conduct of warfare. They also indicate where fault lines lie, and explore how developments in technology and the strategic environment can affect how the law is interpreted and applied.

Courts throughout the world must devote increasing attention to disputes involving patents, copyrights, trademarks, and other types of intellectual property (IP). This book provides a comprehensive overview of the remedies available for the infringement of IP rights, with particular attention to the world’s leading jurisdictions for infringement litigation.

Thomas Cotter – one of the world’s leading experts on remedies for the infringement of IP rights – provides a detailed account of how courts within the U.S., the EU, Asia, and the Commonwealth of Nations address issues such as the standards for awarding preliminary and permanent injunctions; the calculation of lost profits and reasonable royalties; and the availability of other forms of relief including disgorgement of the infringer's profits, punitive and statutory damages, and criminal penalties. Up-to-date and comparative in scope, the book also calls attention to recent developments including global FRAND disputes, the Unified Patent Court, awards of extraterritorial damages, and more.

Remedies in Intellectual Property Law is an essential resource for students and academics with an interest in IP law and litigation. It also provides a valuable resource for lawyers and clients involved in IP disputes, as well as for judges and policymakers tasked with applying, adapting, or extending existing law to new developments in technology, commerce, the arts, and entertainment.
