Paragraphs 79 and 80 of the ECtHR-Judgment Google/Russia: 79. The Court has previously emphasised the specific nature of the Internet as a modern means of imparting and receiving information, recognising that the “duties and responsibilities” imposed on an Internet portal, for the purposes of Article 10 of the Convention, may differ to some extent from those of a traditional publisher in relation to third-party content (see Delfi AS, cited above, § 113). At the same time, the Court notes that when internet intermediaries manage content available on their platforms or play a curatorial or editorial role, including through the use of algorithms, their important function in facilitating and shaping public debate engenders duties of care and due diligence, which may also increase in proportion to the reach of the relevant expressive activity (see paragraphs 49 and 50 above). 80. In the present case, however, the Court considers that penalising Google LLC for hosting content critical of government policies or presenting alternative views on military actions, without demonstrating a pressing social need for its removal, strikes at the very heart of the Internet’s function as a means for the free exchange of ideas and information.
