Since pivoting to pro bono habeas, I’ve written nearly a dozen sanctions motions and started collecting pissed off judges’ decisions with the zeal of a Pokémon stan and the discernment of an oenophile.

Then he brought his work current. 113 more orders violated in 77 more cases.

Simply staggering. In less than 2 months, ICE has violated 210 orders. That’s nearly 4 orders a day, 7 days a week. I’m living through it (filed three motions in the last 24 hours over noncompliance) and I’m shocked.

It seems that, after his last order documenting ~100 violations of court orders, The U.S. Attorney for the District of Minnesota (the top federal lawyer in the state) accused him of lying.

So Judge Schiltz doublechecked. He had made mistakes. Mistakes that UNDERSTATED the government’s misconduct.

It does compute. Anyone “arrested for” or “charged with” certain crimes, including to violent crimes, can be detained by ICE indefinitely, without recourse.

By staying in jail until he could reach a plea deal that did NOT include qualifying crimes, it meant ICE did not have a basis to detain him.
