The Supreme Court made clear in Bostock that transgender workers are protected from discrimination; the EEOC cannot undue those protections. Overturning the Lusardi precedent is just Andrea Lucas’s latest slap in the face to every American who has faced discrimination because of their gender identity. What does this mean for trans workers? Today, the Equal Employment Opportunity Commission issued a decision permitting a federal agency employer to exclude transgender employees from bathrooms that align with their gender identity--overturning a previous EEOC precedent that had held that it was a violation of Title VII for agencies to prohibit transgender employees from using restrooms consistent with their gender identity. EEOC’s decision “applies only to federal agencies subject to the E.E.O.C.’s administrative complaint process for federal employees.” This decision does not apply to private employers, nor does it bind any federal court. Importantly, all transgender employees are still protected from employment discrimination under Title VII of the Civil Rights Act, as confirmed by the Supreme Court’s decision in Bostock.
Today's decision by the EEOC to overturn protections for transgender federal employees is a disgrace.
This is exactly the kind of discrimination the EEOC was designed to fight, but under Trump & Chair Andrea Lucas—the EEOC has enabled more discrimination than it has ended.

The 4th Circuit reversed a lower court's ruling that struck down the military's ban on people with HIV enlisting.
HIV is treatable & servicemembers with HIV have proven they're fit to serve—it's irrational to deny those with HIV the opportunity to enlist. This is discrimination.
