👩⚖️ Key themes include:
• When Article 9 UK GDPR is engaged
• Why legitimate interests and “contractual necessity” are often unsafe legal bases
• The limits of historic waivers
• How data subject rights can be used strategically by performers and their reps
🎬 The note looks at how UK data protection law applies where performers’ voices, faces, likenesses or bodies are used to train or deploy generative AI — including digital replicas — and how those issues interact with performers’ rights under the CDPA, passing off, and EU duties.

We assessed whether current law provides effective protection from harms which could be caused by these tools.
We found a range of issues, & real concerns about gaps in protection as the scale and scope of the public's use of AI assistants grows, and the law struggles to keep up.
Today, the Ada Lovelace Institute launched their report, The Regulation of Delegation. We at AWO (Alex Lawrence-Archer and Lucie Audibert) carried out extensive legal analysis in support of the report.

🎭 Over the past 18 months, our litigation team has been working to support actors and their representatives who are increasingly concerned about the provenance of the data used to train generative AI models.
📣 "We need to be building a world in which the human creativity, connection and performance of actors carries on being valued."
AWO solicitor Alex Lawrence-Archer was quoted in the Guardian this weekend as part of their coverage of AI 'actors' such as Tilly Norwood.
